A recently implemented immigration reform, DACA, or Deferred Action for Childhood Arrivals, allows certain foreign nationals who came to the United States as children and have participated in education or military service in the USA. To apply for DACA treatment, the alien must submit an I-821D Consideration of Deferred Action for Childhood Arrivals, an I-765 Application for Employment Authorization Document, and a I-765 WS – EAD economic need supplement form, in addition to all supporting documentation required by the USCIS for the filing of these forms.

To be eligible for Deferred Action, there are numerous requirements. Some of the requirements are:

Being under the age of 31 year as of June 15, 2012,

Having come to the U.S. while under 16 years of age,

Having lived in the United States continuously since June 15, 2007,

Being physically present in the United States on June 15, 2012,

Being physically present in the United States at the time of requesting Deferred Action,

Being currently in school, or having obtained a GED, or having participated in the armed forces,

Not having been convicted of a felony or “significant” misdemeanor or more than three misdemeanors,

Not posing a threat to national security.
