The I-130 application is for immediate relatives or other close family members who wish to immigrate (by obtaining legal permanent residency, or a green card) to the United States. The requirements between immediate relatives and other close family members differ. Close family members are only allowed to immigrate based on a quota for each qualifying family member who is a citizen or permanent resident. Close family members are divided into preferences, which determines how quickly they are eligible to obtain their green card, or legal permanent resident status. These preferences include unmarried children over 21, married children of U.S citizens, and brothers or sisters of U.S. Citizens. Spouses and unmarried children of a permanent resident have a different set of requirements to get their green card, based on being in a lower preference group than those spouses and unmarried children of citizens.
